Refund Policy – Dataky

IMPORTANT: Because of the downloadable and intangible nature of our digital products, we do NOT accept returns or issue refunds once a product has been downloaded or accessed.

Please read this policy carefully before completing your purchase.

1. GENERAL NO-REFUND POLICY

Dataky offers exclusively downloadable digital products (ebooks, guides, templates, digital resources, etc.). Once a digital product has been downloaded or access has been granted, it cannot be physically returned, and it is not possible to guarantee that the content has not been copied, stored, or used.

All sales are final.

By making a purchase on Dataky, you expressly agree that:

  • You have fully read the product description
  • You understand the digital and non-refundable nature of the product
  • You consent to immediate access to the content and, to the maximum extent permitted by law, waive any cooling-off or withdrawal right for digital content

2. LEGAL BASIS FOR DIGITAL PRODUCTS

In many jurisdictions (for example, under the European Union Consumer Rights Directive 2011/83/EU and its local implementations), consumers may have a statutory right to withdraw from online purchases within a certain period.

However, these regulations often provide an exception to the right of withdrawal for:

“The supply of digital content which is not supplied on a tangible medium if the performance has begun with the consumer’s prior express consent and acknowledgment that they thereby lose their right of withdrawal.”

This means that, once you download or access a digital product, your statutory right of withdrawal may no longer apply, provided you were informed in advance (as we are doing in this document) and you consented to immediate access.

Where applicable law does not allow a full waiver, this Policy will be applied to the maximum extent permitted in your jurisdiction.

3. EXCEPTIONS – CASES WHERE WE MAY CONSIDER REFUNDS

Although our general policy is “no refunds”, we will consider refund requests only in the following exceptional cases:

3.1. Double charge or billing error

If you were charged two or more times for the same product due to a technical error by the payment gateway.

Requirement: You must report this within 48 hours from the date of purchase and provide evidence of the duplicate charges.

3.2. Defective or corrupted product

If the downloaded file is corrupted, damaged, or cannot be opened with the standard applications indicated (PDF reader, Excel, etc.).

Requirements:

  • Report the issue within 48 hours of download
  • Provide screenshots of the error message
  • Confirm that you have tried to open the file on multiple devices or applications
  • Allow our technical team to attempt to fix or replace the file before any refund is processed

3.3. Wrong product delivered

If you received a different product than the one you purchased (for example, you purchased “Ebook A” but received “Ebook B”).

Requirement: Report this within 48 hours and provide evidence of the error (screenshot of the order vs. the file received).

3.4. Product not received

If your payment was completed but you never received the email with the download link and the product does not appear in your “My Purchases” or account area.

Requirements:

  • Report this within 72 hours of payment
  • Provide proof of payment (receipt, transaction ID, etc.)
  • Confirm that you have checked your spam/junk folder
  • Allow our team to resend or restore access before any refund is considered

4. CASES WHERE REFUNDS ARE NOT ACCEPTED

We will NOT issue refunds in the following situations:

  • Change of mind: “I no longer want the product” or “I don’t like the content”
  • Lack of use: “I haven’t had time to use it”
  • Unmet personal expectations: “I expected more content” (when the product description clearly states what is included)
  • Your own technical limitations: “I don’t have the required software to open it” (when such requirements were stated in the description)
  • User error: Accidental deletion, loss of files, hardware failure, or device issues
  • Downloaded products: If the file has already been downloaded, even if you claim not to have opened it
  • Discounted or promotional products: Products purchased with special discounts are considered final sale
  • Late requests: Any request made outside the 48–72 hour period described in Section 3

5. HOW TO REQUEST A REFUND (IF YOU QUALIFY)

If your case meets one of the exceptions described in Section 3, please follow these steps:

Step 1: Contact us immediately

Send an email to info@dataky.net within the applicable time frame (48–72 hours depending on the case) with the subject line: “Refund Request – Order #XXXXX”

Step 2: Required information

In your email, please include:

  • Order number: As shown in your confirmation email
  • Purchase email: The email address used at checkout
  • Purchase date: Exact date of the transaction
  • Detailed reason: A clear explanation of why you are requesting a refund
  • Supporting evidence: Screenshots, duplicate payment receipts, error messages, etc.

Step 3: Review process

Our team will review your request within 3–5 business days and will email you to confirm:

  • Whether your request has been approved or denied
  • The reason for our decision
  • The next steps if your request is approved

Step 4: Refund processing (if approved)

If your request is approved:

  • Your refund will be processed using the same payment method used in the original purchase
  • Processing times may vary depending on your payment provider:
    • PayPal: Typically 1–3 business days
    • Stripe / Card: Typically 5–10 business days
  • You will receive a confirmation email once the refund has been initiated

Note: Actual crediting times depend on your bank or financial institution. Dataky has no control over these time frames once the refund has been issued from our side.

6. ALTERNATIVES TO REFUNDS

Before issuing a refund under the exceptions mentioned above, we will always try to offer alternatives, such as:

  • Resending the product: If there was a problem with the original download or email
  • Technical support: Assistance to resolve access, compatibility, or file-opening issues
  • Store credit: Option to apply your payment toward another product of equal or lesser value
  • Replacement product: If you were sent the wrong file

7. FRAUD PREVENTION

Dataky reserves the right to deny refund requests in cases where we detect:

  • Patterns of repeated purchases and refund requests
  • Evidence that the product has been used, copied, or redistributed
  • False or misleading information in the refund request
  • Systematic abuse of our refund policy

Accounts involved in fraudulent activity may be permanently suspended.

8. QUALITY GUARANTEE

Although we do not offer refunds for change of mind, we do guarantee the quality of our digital products:
